Administration asks SCOTUS to rehear immigration case

Yesterday, the Department of Justice filed a petition asking that the Supreme Court rehear United States v. Texas. In June, the Court issued a 4-4 one sentence nondecision affirming the Fifth Circuit’s preliminary injunction of the Administration’s expansion of the Deferred Action for Childhood Arrivals (DACA) and Deferred Action for Parents of Americans (DAPA). In the petition, the Department of Justice argues that the case is of significant importance and that a decision should be made when it has a full complement of members.  Since February and due to Justice Antonin Scalia’s death, the Court has consisted of only eight justices instead of its usual nine.
